Vinita Kamte, the wife of late 26/11 mayhem martyr Ashok Kamte has written a book alleging the police force ignored crucial information during the terrorist attacks. She said "My book is based on the facts given by the Mumbai police using the RTI Act,"
Vinita claims to have exposed Maria’s ‘feigned ignorance’ about the events unfolding in the Rang Bhawan lane. Kamte, Anti Terrorism Squad (ATS) Chief Hemant Karkare and Senior Inspector Vijay Salaskar, were killed there.

She alleges commissioner Hasan Gafoor told Kamte to rush to Trident Hotel. Later, the control room directed him to Cama Hospital. Maria’s response to her on this was ‘I don’t know’. Gafoor was unavailable for comments despite several attempts.

Vinita also writes about how Karkare’s repeated pleas for reinforcements to block the passage of the terrorists fleeing Cama Hospital went unheeded for over an hour. This, Vinita says, gave terrorists Ajmal Amir Kasab and Abu Ismail free access to the lane.

The control room also failed to move the bleeding officers to hospital in time despite several calls from local residents to the control room, the book claims.

Vinita said she was initially reluctant about writing the book "but my desire to find out the truth about what happened on the night of November 26 leading to my husband's death ultimately triumphed."


If Vinita has shown the courage to come up with such a bold & well researched work we must support her for such courageous act. As a wife of the deceased police officer & ordinary citizen of India she has the whole right to probe into the details of this matter.We must not leave everything to the will & finding of the government departments. Untill & unless we, the ordinary citizen of India show the courage to stand for the justice "true democracy" will never come to the country.Even in the police department lots of scruplous person are involved.

JUDGE : FIRST A MAN OR A JUDGE ?

WILFUL EXIT

The Indian woman’s free will is an elusive entity. The Supreme Court has ruled that a wife who walks out of her matrimonial home “willingly” is not entitled to maintenance. At least, that is what the court has ruled in one specific instance, upholding the ruling of the Punjab and Haryana High Court that denied maintenance to a woman who had left her husband and had filed a complaint against him for demanding dowry. She had moved court asking for divorce on the ground of cruelty, while her husband had filed a petition for the restitution of conjugal rights. This was in 1998. Five years later, the court dismissed her plea for legal separation. No doubt the court in its wisdom had found that her husband was not cruel and that she should have responded to the direction to return to him. She had also left her children behind. It is to be assumed that the husband’s petition for her return and the fact that she had left her children behind had nothing to do with the dismissal of her plea. This is important, because a general application of the principle behind the court’s ruling may pose a grave danger to women forced to leave their husband’s homes without even their children. When this woman applied for divorce and maintenance a year later on the ground that she was living separately, the divorce was granted but not the maintenance.

There are numerous instances in which women fear for their lives in their in-laws’ homes, but have no certainty of food and shelter outside it. In many such cases, the woman leaves home, even if she has to leave her children behind, hoping to somehow bring them out if and when she finds a secure shelter. While the act of walking out is technically “willing”, the result of an independent and possibly secret thought process, can this will be described as “free”? The convolutions of the law, the right of the husband to demand the restitution of conjugal rights — given the dangerous psychology of violent men who desire the presence of their most favourite victims — and the cultural baggage a mother trails, incarcerate women within numberless invisible walls. Of course, all this does not mean that women do not try to manipulate the law or exploit their husbands. Such realities merely indicate the care with which the law must step when a woman petitions for maintenance after “walking out” of her marital home.

this judgement shows that how much a judge is man inside than a judge. WILL A JUDGE OR FOR GOD SHAKE ANY HUMAN BEING WILL CONTINUE TO REMAIN IN A JOB OR RELATIONSHIP WHERE THEY HAVE TO FACE INSULT,TORTURE ,HUMILIATION IN EXCHANGE OF FOOD-SHELTHER & CLOTH .

RIFT BETWEEN ANIL-MUKESH MAY COST UPA GOVT.

The rift between Anil -Mukesh on businees front is taking the shape of ad-campaign in all the national newspapers 's front page advertisements by the Anil Ambani. The add is accusing the governments /ministers that they have favoured the Mukesh group at the cost of the NTPC, a govt organisation. The govt. is now shoeing its displasure and advicing Anil not to do that. The whole episode is indirectly helping Mukesh as anil has directly taken panga with the govt which in the long run may harm its business interest. Mukesh Ambani seems quite intelligent sometime as he don't go public easily but love to do his work behind the scene . Both the brothers have their different work style and have admirers.

The main thing will be after this : what will be the out come for the Anil after such excersice. But in the meanwhile media is being gaining in terms of advertisement revenue.

JASWANT SINGH'S EPULSION FROM BJP

Expulsion of Jaswant Singh from BJP shows that how much we have became intolerable toward different and difficult views.A society progress with debate ,conflict ,different views not with just uniformity of opinions .Jaswant Singh has the whole right to express his opinion ,he never says that this is his party's views .So BJP must not take the decision to expel him.This is like that no one can criticise no one -the true autocratic situation. In congress you can't criticise Nehru- Gandhi family, in BJP you can't praise Jinnah,or senior leadership.Just accept everything as it is.If this is the situation then where is democracy.J L Nehru himself said that in democracy one must have the ability to tolerate opponent's view, which we are loosing very fastly and in its place CHAMCHAGIRI is becoming very popular.
Media should also not blow this out of propotion.Different views of a person is very important for the development of mind ,one must try to think at a subject from different angles.Anybody in politics is for power purpose not for charity purpose either it be Jinnah or J L Nehru. No one is holy cow but we must try to look at them from different angles not in a black-white manner.Jinnah may be the symbol of Hindu-Muslim unity but he was also the person who demanded for Pakistan- a separate nation for muslims. What might be the reasons for which Nehru agreed to have partition and at the same time promised that muslims in India will remain safe.This shows the complexity of human beings's complex decision making nature and admiration for power.This must be look in a different manner. And I think Jaswant Singh only tried to do that.He should not be expelled at least for expressing his views.You may agree with him or you may not.About his view on Patel many people may not vouch for his idea but at least can hear it for sake of hearing.

Recently I was on a visit to my birth place “Dear KOLKATA”. There I met after a gap of a decade to my favourite , intelligent and dynamic teacher who use to teach us maths & stats in CA.- Anil Shah Sir। He is so wonderful person , he got magic to make the tough and complicated study fun.He was darling among the girls and envy for the boys.I know sir will laugh after reading this . But this was the reality. I myself used to see the popularity of Sir among the girl students. Now- a-days Sir is teaching Cost to CA final students. Although very few people know that Sir is a qualified engineer ,he bought the books of cost in order to prepare himself to teach cost to the students.This is Anil Shah , who says where is a will , there is a way. In other word he still teaches us – “never say no to the change, change yourself according to the time and be a winner.No wonder ,I was also a die-hard fan of sir and install his technique of teaching – make study fun
fun, whenever I am teaching to my students of media. Although I don’t teach maths nor CA’s any subjects.

But the funda is the same , make the class enjoyable.This post is a salute to my dear & darling Teacher- ANIL SHAH Sir.

FINANCIAL FRAUD AND INVESTORS AWARENESS

The financial fraud at Satyam cases is the result of lack of awareness among the general masses about their rights as shareholders. Companies Act,1956 provides lots of rights & power to shareholders to look into the day to day business of a company.

Companies Act empower an ordinary shareholder to check the Books of accounts of a company at its registered office by paying a nominal fee। Again If minority of shareholders feel that majorities of shareholders’activities are causing opression and mismanagement in the conduct of business activities. Minority shareholders i.e. one ten in total number or one ten holding of share in terms of volume can write to Company Law Board (CLB). CLB after receiving the complain can take a necessary step to bring the justice .

Again the format of a company is more like a democratic structure ,where ordinary shareholders choose the statutory auditor of the company ।Statutory auditor is the external auditor unlike internal auditor .Internal auditors are the employee of the company and are on the payroll of the company.The statutory auditor are the group of the independent professional firm to whom fees are paid for rendering services. The duty of statutory auditor is to see that all the accounting and auditing principles are followed by the company or not. Whether the company has applied the raised public fund in those area for which it has taken .If auditor find any discrepancies in all these things ,he should “Qualify “ his report by pin pointing those errors. But he has to give an opportunity to the management under natural justice to defend himself .Here come the real problem ,no management would like that their mistake surface before the market ,government & shareholders.So they try to please the audit firms & auditors.

Apart from this there is another instrument by which management want to keep check on the auditor is that they can appoint another auditor in the next AGM. But here there is some defence available to outgoing auditors as incoming auditor has to seek the “no objection” certificate for outgoing auditor. During this time outgoing auditor can inform incoming auditor about the discrepancies existing in the books of accounts of the company. If the outgoing auditor is not satisfied with the behavior of incoming auditor ,he can launch a complain against his fellow member in ICAI .Proven guilty of professional misconduct ,action can be taken against incoming auditor & his firm.

There are lots of points in which if ordinary investor become interested they can put a check on these sort of financial fraud in the very begaining।All this can be done only if investor are made awared by the media & themselves. At the sametime investors have to curb their extra greed to become rich out of inflated price of shares. Very few investors are interested in the day to day fuctioning of management & company rather their sole object is to watch the rise in the price of stock & divided declared by the company and corner a huge profit out of selling their stocks. According to the newly elected President of ICAI Mr. Uttam Prakash Agarwal that an ordinary person can write to ICAI about the Balance Sheet and his signing auditor if he find any doubtful things into that.On receiving the complain ICAI’ s disciplinary committee will take necessary action.

Untill & unless investors rise from the their mental framework there is no point in blaming only the government & management because only the awareness of investor

Can put a check on these sorts of fraud.
